Legal information

In compliance with the provisions of article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we hereby inform you that the entity providing the Services is the company Citam Quality Healthcare Services S.L. (hereinafter, Citam), a Spanish company with registered offices in Palma, C/ Cala Bona, 19, 07009 Palma, CIF B56956873, Commercial Register of Palma, in Volume 3,045, Folio 34, Page PM-99260, 1st inscription.

Object

The purpose of these Conditions of Use (hereinafter the Conditions) is to regulate access, browsing and use of the Citam website (hereinafter the Portal, Web Portal, Website or Web Page). Access, browsing and/or use of the Portal implies acceptance of all the stipulations set out in these Conditions, as well as the Privacy or Data Protection Policy and the Cookies Policy.

There are, however, certain services and content accessible through the Web Portal, which are subject to special conditions that may replace and/or complement the present Conditions.

User status

User shall be understood to be the person who accesses, browses and uses the Web Portal, the services and/or the contents housed therein.

Browsing, access and use of the Web Portal do not require prior registration, however, there are certain services offered through it, access to which is necessarily conditional upon registration and acceptance of the specific conditions governing the service in question.

Access to the Web Portal by minors shall be understood to be expressly authorised by their parents, guardians or legal representatives, who shall be liable for the acts carried out by minors as Users of the Web in accordance with the applicable regulations.

Requirements for use

In order to access the Portal and the services offered, you will need a device that meets the requirements of hardware and software compatibility (which may vary over time) and Internet access. The User shall be aware that these factors may influence the performance of the Web Portal and/or the possibility of accessing the services offered therein.

Citam is not responsible for the impossibility of access or deficiencies in the functioning of the Web Portal and/or the services offered through it due to the use of unsuitable devices, or due to Internet service interruptions resulting from network saturation or any other reason.

Rules of use

Use of the Service: the User undertakes in all cases to use the Portal and its services in a diligent, correct and lawful manner, in accordance with the law, the Legal Notice, these Conditions (and/or those applicable in each specific case), regulations of use and instructions made known to him/her, as well as with morality, generally accepted good customs and public order.

To this end, it shall refrain from carrying out any activity that is illicit, prohibited or harmful to the rights and interests of third parties, or that may in any way damage, render useless, overload, deteriorate or impede the normal use of the services, computer equipment or documents, files and all types of content stored on any computer equipment belonging to Citam, other users or any Internet user (hardware and software).

Acces Control: the User may access only those resources of the information system to which he/she is authorised.

Temporary Files: the information stored on the Web Portal must be consulted on Citam’s systems, and Citam shall in no case be held responsible for the information that the User exports from said Systems.

Terms of use: When the User is using the Web Portal, he/she is responsible for ensuring that the information he/she handles cannot be seen by unauthorised persons..

The User expressly undertakes not to store, use, transmit or disseminate:

  • Cracks, software serial numbers or any other content that infringes the intellectual property rights of third parties.
  • Distribution of viruses via the Internet, worms, Trojans or any other destructive activity, such as saturation, mailbombing, etc. or denial of service attacks.
  • Activities that disrupt or interfere with the effective use of other people’s network resources.
  • The collection and/or use of personal data of other users without their express consent or in contravention of data protection regulations.
  • Share the access codes provided (in the event that the User is registered as a User of a specific service that requires it) with another natural or legal person.
  • Destroy, alter, render useless or in any other way damage the data, programmes or electronic documents of Citam or third parties.
  • Obstructing the access of other users by means of massive and unjustified consumption of the computer resources through which Citam provides any of its services, as well as carrying out actions that damage, interrupt or generate errors in said systems.
  • Use the system to attempt to access restricted areas of the server, without proper authorisation from Citam.

Intellectual and Industrial Property

The design, images, labels, distinctive signs, trade name, brands, logos, products and services, etc. contained on the Website are protected by Industrial Property Law and are the property of Citam, and it may not be understood that the use of or access to the Website and/or the services provided therein grants the User any right over the aforementioned design, images, labels, distinctive signs, trade name, brands, logos, products and services.

Likewise, the Website, its source code and the contents accessed through this site are the Intellectual Property of Citam and/or third parties, and may not be understood to be transferred to the User under any circumstances.

Citam is the owner or licensee of all rights over the content of the Web Portal and the services offered through it. Access to the Website or its services does not grant Users any right or ownership whatsoever over the intellectual or industrial property rights over the Content it contains. The User acknowledges and accepts that its use is strictly prohibited, as well as its reproduction, communication and/or distribution, modification, alteration or decompilation, whether for personal, private and non-profit use or for commercial or profit-making purposes.

Citam reserves the right to take legal action against Users who violate or infringe intellectual and industrial property rights.

User’s responsibility

The User shall be responsible for:

  • Maintain the confidentiality of the Keys provided to you, if applicable.
  • Provide Citam with correct information; any error in the data provided shall be the sole responsibility of the User. Similarly, the User shall be responsible for keeping all information provided to Citam up to date, so that it corresponds, at all times, to the User’s real situation.
  • Any damages that may be caused to Citam or to third parties as a result of the data provided, as a consequence of the use of data that is not updated, false or does not correspond to reality and the use by third parties of the User’s personal passwords.
  • In the event that the User obtains a copy of his/her clinical data, he/she shall be solely and exclusively responsible for the use and custody of such information.

Service availability

The information, contents or services offered through the website are those decided by Citam at any given time and may vary over time. Therefore, there is no obligation to keep services available. However, Users will be informed when it decides to cancel the continuity of a given service and the conditions for its cessation.

Likewise, Citam may cancel access to the services, in whole or in part, to those Users who fail to comply with these Conditions.

Citam’s warranty and liability

Although Citam uses systems that are compatible with most of the technologies on the market, it cannot guarantee the compatibility of the devices used by the User.

Citam does not guarantee the availability and continuity of the operation of the Website or the Services offered. Citam shall therefore be exempt from any liability arising from access to and use of the Website or the services offered through it (performance failures, interruptions or delays in the operation of the Services, system or line failures, etc.), even if a failure or malfunction occurs that causes damage to third-party computer tools. In this sense, the User accesses the Website and the services under his or her sole responsibility.

The services offered through the Website comply with the provisions of Spanish law.

Citam shall not be held liable in the event of improper use of the Portal and/or the services by the User.

Citam shall not be liable in the event of the unavailability of the services due to force majeure or temporary suspension of the same for technical reasons. Therefore, Citam shall not assume any liability for any damages or losses that may be suffered as a result of events that could not have been foreseen, or that were foreseen to be inevitable, either due to unforeseeable circumstances or force majeure.

Citam shall not be held responsible for any failure, technical error, accident, breakdown, manipulation, interruption in the services or any other incident that may arise in products, equipment or technical services not belonging to Citam, the use of which is necessary for access to the services.

Although Citam has acted diligently and has adopted the necessary measures, in accordance with the state of technology, to avoid possible breaches in the security of the Portal, the absolute impossibility of vulnerability of the security measures adopted cannot be guaranteed.

Citam accepts no responsibility for the legality of other third-party websites from which the Portal may be accessed. Nor is Citam responsible for the legality of other third-party websites that may be linked to or linked from this Portal.

Citam shall endeavour, as far as possible, to update and rectify the information contained on its website. However, it shall not be liable for any damages of any kind that may be due to the lack of truthfulness, accuracy, completeness and/or timeliness of the content transmitted, disseminated, stored, made available, received, obtained or accessed via the website.

With regard to health-related information and content, these are provided for information purposes only and Citam recommends that Users always act under professional medical advice.

The User assumes that in the event of taking decisions based on the information provided on the Website, the responsibility shall be exclusively theirs, and shall not be entitled to make any claim whatsoever against Citam for the consequences of the decisions taken.

Modification of content and conditions

Citam may add new functionalities to the Website and/or modify the current Conditions. In this case, the update will be published on the Portal so that the User is aware of any changes. If the User does not agree with the new conditions, he/she shall have a period of fifteen calendar days from the date of notification to terminate the contract by means of reliable notification to Citam. If the aforementioned period elapses without the User having stated anything to the contrary, this shall imply full acceptance of the new conditions.

Jurisdiction and applicable law

This Legal Notice shall be governed and interpreted in accordance with Spanish law. Any dispute that may arise from accessing or using the Website shall be subject to the exclusive jurisdiction of the Courts and Tribunals of Palma, without prejudice to the application of any mandatory provision to the contrary, in which case the content of the same shall apply.
